In consideration of being allowed to use the pickleball facility at Academy of Pickleball in Huatulco, I, the undersigned, hereby acknowledge and agree to the terms and conditions outlined in this Pickleball Facility Use Waiver ("Waiver"). I understand that participating in pickleball and using the facilities involves inherent risks, including the risk of injury or illness. I voluntarily assume all such risks and waive any claims against Academy of Pickleball, its owners, employees, contractors, and agents (collectively referred to as "Facility") relating to the use of the pickleball facility. 1. Assumption of Risks: I acknowledge that playing pickleball involves physical activity and may include running, jumping, sudden movements, and the use of equipment. I am aware that such activities can result in physical injuries, including but not limited to, sprains, strains, fractures, and other bodily injuries. Additionally, I am aware of the potential risks associated with exposure to contagious diseases, viruses, or other illnesses that may be present in communal spaces. I hereby assume full responsibility for any injuries, damages, or illnesses that I may sustain while using the pickleball facility. 2. Release and Waiver: In consideration of being allowed to use the pickleball facility, I hereby release and forever discharge Academy of Pickleball and its owners, employees, contractors, and agents from any and all liability, claims, demands, actions, or causes of action, whether in law or in equity, arising out of my use of the pickleball facility, including but not limited to injuries, damages, or losses that may occur as a result of negligence by Academy of Pickleball, its owners, employees, contractors, or agents. 3. Photography & Video Waiver Release I agree to permit Academy of Pickleball to take video footage and one or more photographs of me and/or my child and to use, reproduce and release to others such images, whether in video, photographic, digital, electronic or other form without payment or other compensation to me or my child, for any of the following purposes: using them in Academy of Pickleball videos, publications, posters, its website or other media, for promotional, social, recreational, cultural, educational, research, commercial, good will and archival purposes. Academy of Pickleball may also provide this video footage and photographs to a third party providing a service for Academy of Pickleball for use in connection with providing that service. I agree not to sue Academy of Pickleball or its employees, officials, officers, volunteers, representatives, agents or contractors, or bring claims or demands of any nature against any of them in connection with any matters referred to in this Photograph and Video Waiver/Release including, without limitation, the use, reproduction or release of my image. If, at any time, I or my child do not wish for a particular photograph or video featuring me or my child to be posted or used by Academy of Pickleball, I have the right to request its removal. I understand that while Academy of Pickleball will make reasonable efforts to accommodate such requests, it is at the sole discretion of the company to decide whether to remove the specific photograph or video. 4. Agreement to Follow Rules: I agree to abide by all rules, regulations, and instructions provided by Academy of Pickleball regarding the use of the pickleball facility. I understand that failure to comply with these rules may result in my removal from the premises without a refund. 5. Indemnification: I agree to indemnify and hold Academy of Pickleball and its owners, employees, contractors, and agents harmless from all claims, demands, actions, or causes of action brought by any third party arising out of my use of the pickleball facility. 6. Limitation of Liability: I acknowledge and agree that, to the fullest extent permitted by law, the total liability of Academy of Pickleball, its owners, employees, contractors, and agents, for any claims, demands, actions, or causes of action arising out of my use of the pickleball facility, including any claims based on negligence or other fault, shall be limited to the amount paid by me to Academy of Pickleball for the use of the pickleball facility. 7. Governing Law and Jurisdiction: This Waiver shall be governed by and construed in accordance with the laws of Province of Oaxaca, Mexico, and any legal action arising under or in connection with this Waiver shall be subject to the exclusive jurisdiction of the courts of Mexico. I have read and understood this Pickleball Facility Use Waiver, and I voluntarily sign it with full knowledge of its contents and significance. I agree that this Waiver shall be binding upon my heirs, legal representatives, and assigns.
